A CLOSER LOOK: voting rights in 2026

defending democracy, The marc elias way

Marc Elias (of "Democracy Docket" fame) has a lot to say about the state of our voting system in 2026. 

He thinks our voting rights are in grave danger. (He's right.) 


He thinks we are too concerned about appearing "alarmist" and not nearly concerned enough about what really matters: meeting the threat to democracy that Donald Trump's fascist movement poses. (He's right again.) 


He has an extensive plan to counter Trump's authoritarian impulses at every step of the electoral process. 

But he needs our help to make it happen. 


How? He needs us to lobby our state legislators and congressional representatives to do the following:


ON THE STATE LEVEL: 


  • Introduce and pass a bill that bans all third-party voting challenges, including those from the DOJ.


  • Revise and strengthen state voter intimidation laws and provide remedies with real teeth for those who are targeted.


  • Revise, strengthen, and streamline state election certification laws.


ON THE FEDERAL LEVEL:


  • Pass a law in Congress to prohibit federal law enforcement from operating within 500 feet of a polling place, election office, or counting location.


  • Pass a law in Congress establishing a federal investigative blackout period around elections, from 30 days before Election Day until one week after the last member of a new Congress is seated.


  • Pass a law in Congress requiring election-related grand jury subpoenas come from the jurisdiction for which they are sought — no more U.S. Attorney shopping!


  • Pass a law in Congress to end immunity of any kind for government officials who interfere with the rights of qualified citizens to vote or have their vote counted.

PRIMARY Election 2026 Q&A

Got questions about voting in New Jersey's upcoming primary election? 


Whether you vote by mail, want to vote early, or plan to cast an Election Day ballot, Door-to-Door Democracy has you covered. 

You can find out your voter status by searching for your voter registration record here. 


 Visit the New Jersey Division of Elections' voter registration hub to get started. To vote in the primaries, you will need to affiliate with a political party. The deadline to vote in this year's primaries is Tuesday, May 12. 


You have two ways to apply for VBM voting. You can apply online or use a printed application. The deadline to submit your VBM application online or by mail is Tuesday, May 26.  You can also apply to vote by mail at your county's Board of Elections until 3:00 PM on Monday, June 1.  


For help completing your VBM ballot, watch this handy instructional video or get written instructions here. 


Nope.  You can hand-deliver it to a county ballot drop box or to your county's Board of Elections. You will be directed to the nearest county drop box if you deliver your VBM to any polling location, Election Day or otherwise. 


Yes! As long as you fill out the "bearer" sections on the outer envelopes of the ballots you are delivering, you can submit up to three ballots of non-family members and up to five ballots of people living in your household.  If you are hand-delivering to your county's Board of Elections, you will be asked to provide ID and sign a register of ballot bearers.  


 Yes, if they are physically unable to complete the ballot themselves. You will need to fill out the official "assistor certificate," located on the ballot's inside envelope. 


Create a voter information record with New Jersey's Division of Elections. You'll be able to log into that site to track the status of your ballot. 


VBM ballots are used to cast actual votes. Sample ballots provide you with Election Day information, including what the voting machine display will look like.  Both are officially marked as either VBM or a sample Election-Day ballot. 


 There will be early voting for this year's New Jersey primary election from Tuesday, May 26 through Sunday, May 31, 2026.  Find your closest early voting county location here.  Polls will be open from 10 AM - 8 PM Tuesday through Saturday and 10 AM - 6 PM on Sunday. 


Sample ballots with this information will begin going out on Wednesday, May 20, 2026. You can also look up your exact polling location by your address here. 


We suggest not waiting until the last minute, whether you are voting by mail or at the polls. 😊  


The polls officially close at 8 PM on Tuesday, June 2, 2026. If you are voting on Election Day and are in line by 8 PM, you can vote.  If you are a VBM voter hand-delivering your ballot, it must be dropped off at a ballot drop box by 8 PM or at your county's Board of Elections by close-of-business that same day. 


Please do not mail your ballot via the U.S. Postal Service this year.
